What is tenancy variation?

A tenancy variation is where one or more terms of your tenancy agreement are changed following a review.  It could be very minor, for example; changing the order of the tenancy agreement, or it could be to include new terms.  It is not a new tenancy agreement.

Why are we varying your tenancy agreement?

We want to improve your tenancy agreement by making it easier to understand and to reflect current law, up to date policies and best practice.  We want to make sure that the agreement is simple for you to understand tenancy breaches and your rights and responsibilities as a tenant.

To ensure every tenant has the same rights and responsibilities, we reviewed all bpha’s tenancy agreements.  On doing so we found many of the agreements were out of date and needed updating to reflect legal changes.

The Housing and Planning Act 2016 has brought about changes that bpha wanted to include to benefit our tenants.

The varied tenancy

To make the agreement clearer, we have changed the format, removed some of the legal terminology and simplified the language wherever we can.

What are the advantages of varying my tenancy agreement? 

Rent – the option to pay your rent monthly, allowing you to set up a direct debit on a day that suits you to make budgeting a little easier

Pets – the ability to request a pet if you live in a flat, something previously you were not able to do

Lodgers – you can ask permission for a lodger in your home

Tenants’ rights – this tenancy variation adds to your current tenancy agreement, giving you additional rights and improved services

Anti-social behaviour (ASB) – changes to reflect the new powers introduced by the Anti-Social Behaviour, Crime and Policing Act 2014

Domestic abuse – new domestic abuse clause, introducing new powers around domestic abuse, around coercion and control

Questions and Answers

What will not change?

Rent – the amount you pay for your rent will remain the same.  Your rent is subject to an annual rent review, at which point you will be notified if there is a change to the amount of rent you pay.

Fencing – as a tenant you are responsible for fencing, this has always been the case, and this will not change if you vary the terms of your tenancy.

What happens for those who were originally council tenants?

If you are a protected assured tenant with preserved rights from when you transferred from the Council, those preserved rights are continued under the new terms and conditions.

Has there been a consultation?

We have consulted with bpha’s Service Improvement Panel, a group of tenants.  They agreed and endorsed the changes to the tenancy agreement.

Do I have to sign the variation document?

It is entirely your decision as to whether you sign the variation or not.  We are happy to give you more information or you can take the proposed document to the Citizens Advice Bureau or any legal advisor for discussion.

Do I lose any of my existing tenancy rights?

No, legally we are not allowed to remove your existing tenancy rights.  You will still have all the same rights as you did at the point that you took your property.

How do I vary my tenancy?

Varying your tenancy is easy.  Just either email bpha info@bpha.org.uk  or call us on 0330 100 0272 and we will send you a document to sign and return to us in a pre-paid envelope, so there are no costs for you.
